Liability Statement
Physical Ability & Hiking Requirements
Our tours take place in the natural terrain of the Southeast Missouri Ozarks and may include hiking on uneven ground, rocky trails, hills, stream crossings, or moderate elevation changes to reach the best photographic locations. Participants should be in reasonable physical condition and able to walk/hike for the duration of the chosen itinerary.
If you have concerns about your ability to complete the hike or access a specific location, please contact us before booking. We will do our best to adjust the itinerary when possible. Inability to complete the planned route due to physical limitations does not qualify for a refund once the tour has begun, though we will always prioritize safety and work with you on alternative options when conditions allow.
Injury & Assumption of Risk
Participation in outdoor photo tours involves inherent risks, including but not limited to slips, falls, uneven terrain, weather-related hazards, and encounters with natural elements. By booking and participating, you acknowledge these risks and agree that Smugala Inc., its guides, and related parties are not liable for injuries, accidents, or losses that may occur during the tour, except in cases of proven gross negligence.
All participants are required to sign a liability waiver prior to the start of the tour. We strongly recommend that clients carry their own personal health or travel insurance.
Insurance
Smugala Inc. carries general liability insurance. Participants are encouraged to maintain their own health, medical, or travel insurance coverage. We are not responsible for personal medical expenses, lost or damaged equipment, or other personal property.
